EXECUTIVE ORDER NO. 115
SECURITY AND PRIVACY COUNCIL

    WHEREAS, agencies of state government must be ever
mindful of the compelling need to assure individual privacy
for the citizens of Massachusetts;

    WHEREAS, there exists a need to consolidate, insofar
as is practical, in a single state agency primary responsi-
bility for insuring that the right to individual privacy is
respected by all state government agencies;

    WHEREAS, the security and privacy council created
pursuant to G. L. c.6, §170 is the existing state agency
having as its primary responsibility the statutory charge to
study, review and make recommendations "concerning questions
of individual privacy and system security in connection with
the collection, storage, dissemination and usage of criminal
offender record information."

    WHEREAS, the expertise arising out of the security
and privacy council's work in the area of criminal offender
record information makes it, with an expanded charge and
an expanded membership, the appropriate state agency to
consider the best methods of assuring respect for
individual privacy throughout the Executive Department
of state government;

    NOW THEREFORE, I, Michael S. Dukakis, Governor of
the Commonwealth, by virtue of the authority vested in me
as Supreme Executive Magistrate, do hereby order as follows:

    1.  In addition to the members provided by G.L. c.6,
§170 (herein known as the "statutory members"), the Governor
shall, from time to time, appoint additional members (herein
known as the "ex officio members"), which ex officio members
shall include the Attorney General, or his or her designee,
and the Secretary of State, or his or her designee, to serve
as ex officio members of the security and privacy council
for a term of one year.

    2.  The security and privacy council shall discharge
the functions provided for by G. L. c.6, §170 and §175, as
such statute has been or may hereafter be amended.  In dis-
charging such statutory functions, the statutory members may
from time to time invite the ex officio members to assist
them.

    3.  In addition to discharging its statutory functions,
the security and privacy council shall conduct a continuing
study and review and shall make recommendations to the appro-
priate cabinet secretary and to the governor concerning ques-
tions of individual privacy in connection with the activities
of state agencies within the Executive Department and 
of private organizations whose activities are the subject
of regulation by such state agencies.  In discharging
these functions all members, both statutory and ex officio,
shall participate under such rules or regulations as the
members may from time to time adopt.
